SB4 Enforcement

The United States Supreme Court on application to vacate the stay has ruled that SB4 can go into effect. The Fifth Circuit had issued an administrative stay pending appeal, so U.S. Supreme Court applied the four -factor test set forth in Ken v. Holder to deny the application to vacate the stay. The case is Las Americas Immigrant Advocacy Center et al. v. Steven McCraw, Director of Department of Public Safety, et al. and it was decided today.

And hours later the 5th Circuit worked on the case so the stay is still in place.
